Cody Is ‘Perplexed’ Why Trademark Continues To Be Denied

Cody Rhodes is not giving up on trademarking his father’s nickname “The American Dream”. He’s been rejected twice by the United States Patent and Trademark Office for the filing.

The trademark was first denied on March 24, 2019, then later on July 24, 2020. The reason behind the rejected was due to proper documentation showing the  “The American Dream” used in entertainment services, specifically live appearances and appearances by a professional wrestler.

HeelByNature.com has obtained an updated ‘Request for Reconsideration After Final Action’ filed on August 20, 2020.

“Applicant and its counsel are bewildered and perplexed as to how the instant application and specimens provided with respect to the Class 041 services could be again rejected.” Cody’s response filing stated. “Counsel has filed literally dozens of applications on behalf of professional wrestlers with specimens identical in nature to those filed in respect of the instant application”

The filing urges the trademark office to contact Cody’s legal counsel to resolve any issues with documentation, rather than waste time and resources with the appeal process.

Applicant requests that, rather than appeal the case, something he is fully prepared to do, if the prior-filed specimens are again somehow not deemed acceptable, that counsel be contacted to resolve any lingering issue so that the time and resources related to the appeal can be avoided.



This isn’t the only issue Cody is dealing with regarding trademarks. Earlier this summer, The United States Patent and Trademark Office once again denied Cody’s request to file trademark for ‘Bash At The Beach’ due to confusion with WWE’s ‘The Bash’ trademark.
