Stadium Stampede Trademark Suspended Due to Confusion With WWE Trademark Filing
All Elite Wrestling’s trademark filing for Stadium Stampede has been suspended by The United States Patent and Trademark Office.
AEW filed trademark for the name on 8/6, to be used specifically for wrestling events. The company produced one match under the name during AEW Double Or Nothing this past May.
The USPTO argues the name cannot be trademarked due to two issues, the first being the use of the word ‘Stadium’, which must have a disclaimer indicating it is being used simply as descriptive wording.
The trademark office suggested AEW submit a new application, with the wording, “No claim is made to the exclusive right to use “STADIUM” apart from the mark as shown.”
The second issue is due to WWE having a pending trademark for the term Spring Stampede, a pay-per-view event previously produced by WCW. WWE filed trademark for the name on 1/6/19, but it has yet to be approved.
WWE’s trademark for Spring Stampede is under review, and requires re-filing due a “identification of services” issue, which will likely be resolved once WWE amends the filing.
On 12/3, AEW fulfilled the USPTO’s first request to submit an application specifying no exclusive right to use the world “STADIUM”, but failed to argue why they should be granted a wrestling related trademark using the word “STAMPEDE”. On 12/7, the USPTO suspended AEW’s filing for the trademark.
AEW is utilizing the services of Intellectual Property lawyer Bradley Mark Stohry. The company previously used the services of ‘Gimmick Attorney’ Michael E. Dockins.
WWE has until March 2021 to update their trademark for Spring Stampede, if they fail to do so, it will be abandoned.
