Original Lawsuit Dismissed, Cabana Files Second Lawsuit
Colt Cabana has filed a second lawsuit against CM Punk in Cook County Courts. This comes after his first lawsuit against the former WWE star was dismissed. PW Insider originally reported that the second lawsuit was filed.
We have obtained court documents showing an up-coming case conference for the second lawsuit that has been filed.
The original lawsuit stems from the lawsuit between WWE doctor Christopher Amann vs, Colt Cabana and CM Punk. After that lawsuit was dismissed, Cabana alleges CM Punk would assist with his legal fees. CM Punk allegedly said he was on his own, and Cabana filed a lawsuit. Cabana wanted $1 Million in punitive and exemplary damages, and $200,000 general fees to cover his costs in the Amann lawsuit. The lawsuit Cabana filed against Punk was dropped as it showed that nothing was deliberately done by Punk to defraud Cabana. There was also no binding contract that showed Punk agreed to pay his legal fees.
Since Cabana’s lawsuit has been dismissed, he has since filed a second lawsuit, and has reiterated the fact that Punk said his attorney would “handle it” after Cabana was sent a letter from Amann’s council. Cabana also believes that Punk went on his Art Of Wrestling Podcast knowing that statements he made on the show would cause WWE legal council to come after him
CM Punk has until 12/28 to respond to the latest lawsuit, and a case conference is scheduled for 1/4.
