Judge Dismisses ‘Frivolous’ Lawsuit Against WWE Filed By Fan

Florida Judge Dismisses Lawsuit Filed Against WWE

A district judge in Florida dismissed a complaint filed against World Wrestling Entertainment by a Fort Lauderdale man on 1/29, finding that his lawsuit ‘frivolous or malicious’.

On 1/25, a man named Cedric Cunningham filed a $500 billion lawsuit against WWE, for emotional distress, cruel and unusual punishment, and discrimination according to court documents obtained by HeelByNature.com.

The lengthy complaint was hand written, and claims WWE uses “sorcery” to degrade the man to millions of viewers during television broadcasts.

Lawsuit filed on 1/25 against WWE

Judge Raag Singhal was quick to dismiss the case, stating it would be a waste of public funds to move forward, ordering the case closed, and denying any further motions.

“Expenditure of public funds and the valuable time of the courts in order to prosecute an action that is totally without merit”

Upon review of Plaintiff’s Complaint, the Court has determined that the conclusory allegations of the Defendant’s denial of Plaintiff’s Eighth and Fourteenth Amendment rights and the Defendant’s commission of a hate crime under 18 U.S.C. § 249 are unsupported by any factual allegations, do not satisfy the pleading requirements of Federal Rule of Civil Procedure 8(a), and fail to state a claim upon which relief can be granted. The Court therefore finds that this case is properly dismissed under 28 U.S.C. § 1915(e). Accordingly, it is hereby ORDERED AND ADJUDGED that Plaintiff’s Complaint (DE [1]) is DISMISSED. The Clerk of Court is directed to CLOSE this case and DENY AS MOOT any pending motions. DONE AND ORDERED in Chambers, Fort Lauderdale, Florida, this 29th day of January 2021.
